.CAROLINA DISCOUNT FURNITURE TERMS AND CONDITIONS OF SALE

 

NEW MERCHANDISE GUARANTEE:

When you place an order with Carolina Discount Furniture, we submit a special order to the manufacturer on your behalf.  All items ship brand new, direct from the manufacturer.

PAYMENT POLICY:

Carolina Discount Furniture accepts MasterCard, Visa, Discover, PayPal, Money Order, Cashier’s Checks, Personal Checks and Wire Transfers.  Payments entered via credit card or PayPal will be charged in full at the time of purchase.  Payments via credit card provided over the phone can be split into two payments.  Orders paid via personal check will not be submitted to the manufacturer until 10 business days from the date Carolina Discount Furniture deposits the check.

All orders must be paid in full upon receipt by our delivery company.


LIMITED WARRANTY FOR DAMAGE OR DEFE

Limited Warranty for Damage or Defect – IN-HOME DELIVERY WITH ASSEMBLY:

Carolina Discount Furniture “Limited Warranty for Damage or Defect” guarantees that for In-Home Delivery with Assembly service, we will restore or replace (at our expense and discretion) goods delivered incorrect, damaged, or defective, as long as you follow these instructions:

1.     Note damage/defect/shortage/incorrect items on the delivery paperwork at delivery.

2.     Refuse ONLY the incorrect, damaged, or defective goods at the time of delivery.

The order will be delivered and set-up in your home.  The person accepting delivery is responsible to inspect the top, bottom, left, right, front, back, interior, exterior, and all moving parts, including, but not limited to drawers, doors, and reclining mechanisms.  The person accepting delivery is also responsible to inspect the assembly provided by our delivery partner.

Carolina Discount Furniture does not warrant or guarantee assembly and is not responsible for damage to goods, personal property, or persons due to improper assembly.  Our delivery partner will assemble the furniture, and any improper assembly must be addressed at the time of the delivery.  As the customer accepting delivery, it is your responsibility to ensure that your order is assembled properly and you agree that you are responsible for issues that arise from improper assembly.

For IN-HOME DELIVERY WITH ASSEMBLY service, items may be blanket-wrapped or cartoned (at the shipper's discretion).

PLEASE NOTE, for orders that include “IN-HOME DELIVERY WITH ASSEMBLY” service, Carolina Discount Furniture CANNOT restore or replace incorrect or damaged or defective goods at no charge after the delivery team leaves.  Damage found after delivery CANNOT AND WILL NOT be attributed to the manufacturer or delivery company.  Items shipped incorrectly will not be reordered unless the wrong item is returned at delivery.  Restoration or replacement is the sole remedy for items that arrive incorrect, damaged, or with defect.  Requests to cancel orders for items arriving incorrect, damaged, or defective will be honored in accordance with our Cancellation & Return Policy (see below).

Limited Warranty for Damage or Defect – GROUND (DROP-SHIP):

Carolina Discount Furniture “Limited Warranty for Damage or Defect” guarantees that for “Ground” delivery service, we will restore or replace (at our expense and discretion) goods delivered incorrect, damaged, or defective, as long as you follow these instructions:

1.     Notify Carolina Discount Furniture of damage/defect/shortage/incorrect items within 24 hours of delivery.

2.     Provide pictures of the packaging and damaged/defective/incorrect items within 24 hours of delivery.

PLEASE NOTE, for “GROUND” delivery, Carolina Discount Furniture will not remedy, restore, or replace items that arrive with damage or defect if the issue is reported more than 24 hours after delivery.  For “Ground” delivery orders that arrive with damage or defect, retain all packaging and report the damage or defect to the shipper AND Carolina Discount Furniture within 24 hours of the delivery.   Restoration or replacement is the sole remedy for items that arrive incorrect, damaged, or with defect.  Requests to cancel orders for items arriving incorrect, damaged, or defective will be honored in accordance with our Cancellation & Return Policy (see below).


For IN-HOME DELIVERY WITH ASSEMBLY, if a manufacturing defect is found after delivery and within the manufacturer’s warranty period, please contact Carolina Discount Furniture for assistance.  It is the manufacturer’s sole discretion as to whether defective goods are restored or replaced.  The shipping to replace defective goods is not covered by the manufacturer or Carolina Discount Furniture.

Accidental transit damage, defects missed at inspection, shortages, and/or incorrectly shipped items occur for 5-7% of the orders we process.  It is the responsibility of the customer – or his/her agent accepting delivery – to inspect merchandise upon delivery to make sure the order is correct and free from damage or defect.

The purchaser agrees to allow up to 9 weeks for Carolina Discount Furniture to provide a resolution for missing items or those that arrive incorrect, damaged, or with defect.

Manufacturer Warranty

For manufacturer warranty information, please see the product page and locate "Manufacturer Warranty: Click here for details".  Most products sold on the Carolina Discount Furniture website are intended for residental/private use.  Use in a commercial/retail setting, in rental properties, or other applications not considered to be household usage may not be covered by the manufacturer warranty.  See manufacturer's warranty for coverage information.  If no warranty information is listed on the product page, contact Carolina Discount Furniture for more information.

 
SHIPPING POLICY:

“In-Home Delivery with Assembly” Shipping Service & Description:

A typical order that includes “In-Home Delivery with Assembly” service will take 4– 6 weeks to most areas.  Items that are on back order may take up to 16 weeks for delivery. Please be sure to call a representative to check stock availability.  Deliveries may take place Sunday - Saturday between the hours of 8am - 9pm. If your job requires that you frequently travel the delivery company in no way can guarantee you a particular day of your choosing for deliveries as there are so many variables involved in furniture delivery over large geographical areas. You may have to wait for the next truck available in your area if your schedule conflicts with routing by the delivery company.

For orders that include "In-Home Delivery with Assembly”, our delivery partner will call you to arrange a delivery time prior to routing your order.  Typically, our delivery partner will contact you a week prior to your delivery date and provide a one-day delivery window with far western states receiving a two day window.  Prior to loading the delivery truck with your order, our shipping partner will conduct a “pre-load inspection” to ensure the order is free from damage or defect.  If damage or defect is found and the issue cannot be resolved in time for the trips departure, our delivery partner will contact you as soon as possible to cancel the delivery date.  Carolina Discount Furniture cannot compensate customers due to delays resulting from damage/defect found during “pre-load inspection”.  If no damage or defect is found during the “pre-load inspection”, your order will be loaded out for delivery. 

Please note, it is up to the discretion of our delivery partner as to when assembly will be completed.  In some cases, assembly can be completed in the delivery warehouse.  Other items must be assembled in the customer’s home.  Items may be blanket-wrapped or cartoned (at the shipper's sole discretion).

The "In-Home Delivery with Assembly" service includes setup and assembly in your room of choice. Delivery allows for up to two flights of stairs. Packaging will be removed by the delivery company.

The customer – and only the customer (or his/her agent accepting delivery) – is responsible to measure doors, stairs and pathways to ensure the goods/furniture can be delivered into the home.  Our delivery partners require 3” additional clearance around all sides of the goods delivered.  At delivery, if the 3” clearance is not available, all goods will be delivered to the first dry area of the home, building, or business (i.e. lobby, garage, carport, etc.)  If you must cancel or return an order because the items cannot be delivered to the home or the first dry area of the home, Carolina Discount Furniture will accept the returned/cancelled order in accordance with our Cancellation & Return policy.

The safety of our customers and our delivery drivers is of utmost importance.  For this reason, the delivery drivers may or may not wear gloves or booties when making delivery.  By submitting an order with Carolina Discount Furniture, you agree that you will not impede the delivery process.  Additionally, you will not board the delivery truck for any reason.  You agree that any assistance you provide during delivery is provided at your own risk.

Please note, our delivery partners will not connect electrical components;  connect plumbing; nor install, attach, or affix goods to fixtures, walls, or furniture in your home.  Cleaning of the furniture is not included as part of In-Home Delivery with Assembly.  The following commonly requested services are not part of your In-Home Delivery with Assembly service: hanging mirrors on walls, installing anything that attaches to a permanent fixture, assembly of cribs, attaching headboards to existing bed frames, installation of adjustable wood/glass shelves, or precise leveling of furniture.  Please note, water fountains and floor/grandfather clocks will be delivered into your home and set in place.  The plumbing, electrical, mechanical, and/or operational set-up (also known as “turn-key set-up”) IS NOT included with your In-Home Delivery with Assembly service.  If you would like “turn-key set-up”, please contact Carolina Discount Furniture after delivery, and we will help you locate an authorized service provider in your area.  “Turn-key set-up” fees are paid by the purchaser to the service provider directly.

You may require or request additional services to complete delivery.  The services listed below are available to you for an additional fee and typical fees are provided.  If your order and/or delivery incurs additional fees, you agree to pay the fees to Carolina Discount Furniture our delivery partner.

In-Home Delivery with Assembly deliveries may occur earlier or later than scheduled due to the nature of long-distance, nationwide shipping and unforeseen events.  While we apologize for any inconvenience you experience, Carolina Discount Furniture is unable to offer compensation for inconvenience to you and/or deliveries that do not occur as scheduled.

Carolina Discount Furniture recommends some extra precautions for the customer/purchaser to consider for orders delivered with In-Home Delivery with Assembly service to ensure a smooth delivery experience:

    Allow at least one hour buffer before and after the scheduled delivery time for unforeseen circumstances that would cause the delivery to occur earlier or later than scheduled

    Designate a friend or family member over the age of 18 to serve as a “back-up” to accept and inspect the delivery on your behalf, and make sure they understand what to do if the order arrives with damage

    Clear the room and all pathways to the room in which you would like the items to be delivered, and measure all doors and pathways to ensure your order fits into your home.  For the goods delivered, allow 3" clearance on all sides through the pathways and doors.

    Take pictures of items that arrive with damage or manufacturer defect, as digital images are often required by the manufacturer

Please note, the delivery trucks may be loaded or depart for your area several days in advance of your delivery.  Once you confirm a delivery date for In-Home Delivery with Assembly with our delivery partners, if you must cancel or miss that confirmed date, additional shipping fees will apply.  If you cancel your confirmed delivery, and your order has already been loaded for delivery, you will incur and agree to pay 33% of your order total to cover the additional shipping fees to schedule a second delivery.

Carolina Discount Furniture does not offer exchanges at no charge to the customer/purchaser.

CANCELLATION & RETURN POLICY:

All requests to cancel or return an order must be submitted in writing, via e-mail.

Requests to Cancel an order within 24 hours of purchase must be e-mailed to info@carolina-discountfurniture.com. Carolina Discount Furniture will provide a full refund as long as the order has not shipped from the manufacturer.  Cancellation is not complete until confirmed via e-mail by a Salesperson.

Requests to Cancel an order more than 24 hours after purchase must be e-mailed to info@carolina-discountfurniture.com.  Carolina Discount Furniture will deduct a 30% restocking fee and any outbound shipping fees from the retail price to determine the refund amount.  Shipping charges paid by the customer will be refunded.  The outbound shipping fee is the shipping expense that Carolina Discount Furniture paid to provide delivery to the customer.  The restocking fee is calculated on the retail price.

Requests to Cancel/Return an order at delivery must be noted on the delivery paperwork, and the customer must also e-mail info@carolina-discountfurniture.com.  Carolina Discount Furniture will deduct a 30% restocking fee and outbound shipping fees from the refund amount.  Shipping charges paid by the customer are non-refundable.  The outbound shipping fee is the shipping expense that Carolina Discount Furniture paid to provide delivery to the customer.  The restocking fee is calculated on the retail price.  Orders returned due to damage or defect will be restored or replaced at no charge to the customer.

Requests to Cancel/Return an order after delivery and within 7 days of delivery must be authorized by Carolina Discount Furniture, and the customer must e-mail info@carolina-discountfurniture.com. The customer will return any item at his/her expense via a carrier that provides the same level of shipping service as specified for the returning item on the original order.  All returned items will be inspected.  Carolina Discount Furniture will deduct a 25% restocking fee and outbound shipping fees from the retail price to determine the refund amount.  Shipping charges paid by the customer are non-refundable.  The outbound shipping fee is the shipping expense that Carolina Discount Furniture paid to provide delivery to the customer.  The restocking fee is calculated on the retail price.  If items are returned in “used” condition, an additional 15% usage fee will be deducted from the refund amount.  

Unauthorized returns will not be accepted and no credit/refund will be given.  


DELIVERY TIMEFRAME:

Typically, orders delivered with “In-Home Delivery with Assembly” service will take 4 – 6weeks to most areas. Deliveries to the far western US can take longer.  Custom and/or Made-to-Order furniture may take up to 16 weeks for delivery.

Delivery timeframes vary depending on availability and the delivery location.  The customer will receive an order confirmation from his/her salesperson that will list the estimated delivery timeframe.  Carolina Discount Furniture does not issue compensation for deliveries that occur sooner or later (within reason) than the estimated delivery timeframe.

DISCLAIMER ON REPRESENTING GOODS, FINISHES & DISTRESSING

Carolina Discount Furniture offers thousands of products on our website.  We do all that we can to provide the most accurate and complete product information.  The customer/purchaser is responsible to review the Carolina Discount Furniture website for all information, details, features, pictures, videos, construction/quality rating, and/or distressing rating for each item ordered.

Carolina Discount Furniture is responsible to deliver all goods up to the Manufacturer’s Standards and Tolerances.  We cannot anticipate customers’ expectations or preferences for color, quality, scale, acceptable level of distressing, and/or fitness for a particular use.  Our obligation and guarantee is to deliver the goods up to the Manufacturer’s Standards and Tolerances.  If a customer requests to cancel or return furniture because it does not meet his/her subjective expectations or preferences, he/she may cancel or return an order in accordance with our Cancellation & Return Policy.

Customer’s purchasing online should be aware that there are several reasons an item may look different online than in person.  Below is a list of the most common reasons an item will look different in person than it does online.

Pictures:  We use pictures from the manufacturer to represent items.  Whether printed or digital, pictures are representative of the actual item.  Computer screens and your setting preferences can distort color.  Studio lighting is often very different from environmental or home lighting.

Manufacturing Changes: Changes in production can affect design features, dimensions, and the appearance of fabrics and/or finishes.  Manufacturers may change production and determine the change does not warrant the expense to reshoot a collection.

Preferences and Perception of Color & Quality:  Many characteristics such as color, quality, and/or amount of distressing are subjective.  Every person interprets wood species, color descriptions, color, and quality differently.  Customers may view a picture and believe the finish will match something in their home.  That is the customer's preference, but it may not be the reality for how the piece is finished.  Carolina Discount Furniture cannot anticipate a customer's preference or expectations for an item.  Please consider this before deciding to purchase online.

Distressing/Reclaimed/Refurbished furniture:  Distressing techniques are typically hand-applied and will vary in quantity and location from piece to piece.  Items made from reclaimed or refurbished materials will vary in color, texture, and character marks.

Natural Materials have variation: Each piece of furniture made from natural materials like wood, leather, stone, etc. will have its own unique fingerprint.  Wood variations include but are not limited to wood grain, wood grain pattern (as determined by the cut of the veneer), mineral streaks, knots, burls, lightness/darkness dependent on the location in the log from which the wood is cut.  Leather variations include but are not limited to skin blemishes (warts or moles), healed scars, veining, wrinkles, urine/manure burns, and leather graining.  Depending upon the finish on the leather, these inherent characteristics will be more or less visible.  Stone variations include but are not limited to differing grain pattern, grain density, color, veining, pit holes, and cleft.

For these reasons, customers purchasing online should be aware of and expect variation from the appearance of the item on our website to the appearance of the item that arrives to their home.


MANUFACTURER-DIRECT ORDERING, AVAILABILITY & BACKORDERS:

We do not stock goods/furniture/merchandise, and availability for items is subject to change.  We cannot and do not guarantee that all goods/furniture/merchandise advertised on our site are in-stock, active, or available to ship immediately.  We do our very best to remove discontinued products and collections in a timely manner.  If we find that an item is on backorder, we will provide prompt notification.  If an item is discontinued, we will cancel the order and issue a refund.

 
RIGHT TO CORRECT AND/OR CANCEL:

Carolina Discount Furniture reserves the right to correct pricing and/or product descriptions upon discovery of incorrect pricing and/or product descriptions.  This includes corrections to quotes and submitted orders.  Carolina Discount Furniture reserves the right to cancel any order for any reason, and we will offer a full refund if we choose to cancel your order.

 

DISPUTES, DEFAMATION & PARTIAL DELIVERIES:

In the event of a dispute of payment, charge back inquiry, or credit card dispute, Carolina Discount Furniture reserves the right to pursue legal recourse to recuperate expenses incurred to deliver orders, regardless of the bank or credit card company’s finding for the dispute.  The purchaser agrees to allow up to 9 weeks for Carolina Discount Furniture to provide a resolution for items that arrive incorrect or with damage or defect.  If Carolina Discount Furniture wins in court, the customer agrees to pay the sale price of the goods, plus any additional shipping incurred by Carolina Discount Furniture, plus all collection and attorney’s fees associated with the collection and/or legal process.

If the customer defames Carolina Discount Furniture with untrue or incomplete information in public reviews, to credit card companies, or to the Better Business Bureau, Carolina Discount Furniture reserves the right to recuperate all damages caused by the customer.

If Carolina Discount Furniture cannot restore or replace an item, Carolina Discount Furniture will issue a refund for that item.  If the item was purchased as part of a set, Carolina Discount Furniture will issue a refund for any item that we cannot restore or replace.  If the customer would like to return items from a set because Carolina Discount Furniture cannot restore or replace an item in a set, the customer agrees to follow the Cancellation and Return policy specified above.

In cases of payment dispute, charge back inquiry, or credit card dispute, if items delivered free from damage or defect are included in the amount in dispute, Carolina Discount Furniture will consider the goods delivered to be a theft of Carolina Discount Furniture property.  If and when the dispute is settled in favor of the purchaser, and Carolina Discount Furniture will pursue legal action for the theft of Carolina Discount Furniture property.


TERMS OF SALE:

By submitting an order on the Carolina Discount Furniture website, you are entering a Contract of Sale governed by these Terms and Conditions of Sale.  You are additionally indicating that you have read and agree to the following policies and guarantees made by Carolina Discount Furniture, including:

You agree to pay for the complete order, or items delivered, as long as Carolina Discount Furniture orders and ships the manufacturer(s) and model number(s) in the order confirmation.  Carolina Discount Furniture makes no other express or implied warranties, including implied warranties of merchantability or fitness.  Carolina Discount Furniture offers the “Limited Warranty for Damage or Defect” and "Cancellation & Return Policy" as our sole obligation and exclusive remedy.  Carolina Discount Furniture is not liable for any incidental or consequential damage.

By submitting an order via our website, you agree to waive all rights to a trial.  All disputes shall be settled by arbitration, pursuant to the Federal Arbitration Act, by a certified arbitrator in a location near your residence.  The foregoing agreements regarding arbitration do not apply to disputes concerning the “Limited Warranty for Damage or Defect”.

By submitting an order via our website, you agree to pay $1,000 (one thousand dollars), up to the maximum dollar amount available by law, if you file a complaint with any agency, website, organization, or credit card company, and the complaint is proven to be untrue by a certified arbitrator from your local area.  In addition to this amount, you agree to pay Carolina Discount Furniture legal fees, the price of goods, and/or storage fees.

By submitting an order via our website, you agree to pay all reasonable legal fees and storage fees associated with your merchandise until we receive payment, if you disrupt payment for any reason.  Carolina Discount Furniture cannot deliver, remedy, restore, or replace goods until the dispute is resolved.  If Carolina Discount Furniture. challenges the disruption of payment and the dispute is reversed in Carolina Discount Furniture's favor, you agree to pay Carolina Discount Furniture $500 (five hundred dollars), legal fees, the price of goods, and/or storage fees.

You agree to pay $3,000 (three thousand dollars) in addition to legal fees, storage fees, and the full price of the goods, if Carolina Discount Furniture is required to hire a collections agency for payment of damages or disputes as noted above.
